3. INTELLECTUAL PROPERTY RIGHTS

On copying models

A recurring thread (and threat to the peace and quiet of the list, not to mention the signal-to-noise ratio) is about copying Games Workshop's models.

Here is a statement made by Phil Gallagher for and on behalf of Games Workshop Limited:

"The international conventions on copyright are quite clear. Copyright means what it says. It gives the creator/owner of the work the sole right to copy it. Whether the copying is done for profit or not is completely irrelevant. If you copy any work which falls under the definitions of a copyright work (eg, words, pictures, computer programs, musical recordings, television or radio broadcasts etc.) then you are liable to a civil action for copyright infringement. Further, it is a civil tort to import, possess in the course of a business, and authorise or purport to authorise others to make copies without the express permission of the copyright owner.

The only significance attached to whether an infringing copy is made for profit or not relates to the amount of damages a court would award to the copyright owner. However, always bear in mind that deliberate and wilfull copying can be subject to punitive damages. "
